1. Acceptance

1.1By accessing or using lumoraprojectsco.com (the “Site”), submitting an enquiry, or booking a consultation, you agree to these Terms of Use. The Site is operated by Lumora Projects Co Limited, a company incorporated in Hong Kong (“we”, “us” or “our”). If you do not agree, do not use the Site.

2. The Site and Our Services

2.1The Site describes our advisory and consulting services and lets you make enquiries and book consultations. Content on the Site is general information only. It is not legal, tax, accounting, financial product or medical advice, and you should obtain advice from a licensed adviser where you need it.

2.2Our services are provided under written engagement terms we agree with you, or, for a booking or purchase made through the Site, under these Terms and our Refund and Dispute Policy. If engagement terms conflict with these Terms, the engagement terms prevail.

2.3Submitting an enquiry or booking a consultation does not create a client relationship or oblige us to accept you as a client.

2.4Nothing on the Site is an offer capable of acceptance, a guarantee of any result, or a representation about future business performance, revenue or growth.

3. Eligibility and Your Obligations

3.1You must be at least 18 years old to use the Site. You must provide accurate, current and complete information when you submit an enquiry or booking.

3.2You must not:

  1. 3.2.1use the Site unlawfully, or in breach of any data protection or anti-spam law;
  2. 3.2.2interfere with the Site’s operation, attempt unauthorised access, or introduce malware;
  3. 3.2.3scrape, harvest or reverse engineer the Site or its content;
  4. 3.2.4impersonate any person; or
  5. 3.2.5use the Site to harass, spam or send unsolicited communications.

4. Intellectual Property

4.1All content on the Site, including text, graphics, logos, trade marks, methodologies, frameworks and software, is owned by or licensed to us. You are granted a limited, non-exclusive, non-transferable licence to view and use the Site for personal, non-commercial and enquiry purposes. You must not copy, modify, distribute, reverse engineer or commercially exploit any Site content without our prior written consent.

4.2Using the Site, submitting an enquiry or booking a consultation transfers no intellectual property rights to you and grants no licence beyond the one in clause 4.1.

4.3Any feedback or suggestions you provide are not confidential and may be used by us without restriction or compensation.

4.4You keep ownership of any material you submit to us. You grant us a licence to use it to respond to your enquiry and to provide any services you engage us for.

5. Privacy

5.1Our Privacy Policy explains how we collect, use and protect personal data, including call recordings, AI processing and transfers of your data outside Hong Kong. It sets out the legal bases we rely on, and where the law requires your consent we ask for it separately.

6. Third-Party Links and Tools

6.1The Site may link to or integrate third-party websites or tools, including booking, calendar, payment, analytics and AI tools. We do not control them and are not responsible for their content, availability, security or practices.

6.2Where the Site uses artificial intelligence or automated tools to generate information, those outputs are provided for preliminary information only. We make no representation about their accuracy, completeness or originality.

7. Disclaimers and Liability

7.1The Site is provided on an as-available basis. We do not warrant that it will be uninterrupted, error-free or free of harmful components, or that its content is complete or current.

7.2Nothing in these Terms excludes, restricts or modifies any right or remedy under a law that applies to you and cannot lawfully be excluded, including the Control of Exemption Clauses Ordinance (Cap. 71) of Hong Kong and the Australian Consumer Law where it applies.

7.3Subject to clause 7.2, our total liability arising out of your use of the Site is capped at HKD 1,000.

7.4Subject to clause 7.2, we are not liable for indirect or consequential loss, loss of profit, loss of data or business interruption.

8. Indemnity

8.1You indemnify us against any claim, loss or cost arising from your breach of these Terms, your misuse of the Site, or your infringement of a third party’s rights.

9. Access to the Site

9.1We may suspend or withdraw your access to the Site at any time if you breach these Terms, or where we reasonably consider it necessary to protect the Site or its users. The clauses on intellectual property, liability and indemnity continue to apply after your access ends.

10. Changes

10.1We may update these Terms by posting the updated version on the Site and updating the date above. Continued use of the Site after a change is acceptance of the updated Terms.

11. General

11.1If any provision of these Terms is found unenforceable, the rest continues in force.

12. Governing Law

12.1These Terms are governed by the laws of the Hong Kong Special Administrative Region, and the courts of Hong Kong have exclusive jurisdiction over disputes arising from the Site or these Terms.
